Administrative Regulations

The Kentucky Division of Water (DOW) administrative regulations are contained in Title 401 Chapters 4, 5, 6, 8, 9 and 10 of the Kentucky Administrative Regulations (KAR).

All state regulations are available at the Legislative Research Commission (LRC) regulation Web site. The regulations contained on the LRC Web site are not official versions. The official versions are contained in the Kentucky Administrative Regulations Service and in the monthly Administrative Register of Kentucky. Newly Effective Administrative Regulations

Several administrative regulations have recently completed the promulgation process.  The official version of these administrative regulations will be available on the LRC Title 401 Web site.

Status of Division of Water Administrative Regulations

Triennial Review Regulations

DOW recodified the water quality standard administrative regulations from 401 KAR Chapter 5 to Chapter 10 in June 2008.  

401 KAR 10:026, 10:029, and 10:031 were approved during the May 12 Administrative Regulation Review Subcommittee (ARRS) meeting.  They will become effective July 3, 2009.

401 KAR 10:030 was approved during the June ARRS meeting with agency amendments.  It will be referred to a second committee in July. The amended version of the regulation can be found here.

Drinking Water Regulation Package Two

DOW filed 401 KAR 8:040 "Laboratory certification" and 401 KAR 8:050 "Drinking water program fees" with LRC  on Jan. 9, 2009. 

The proposed amended administrative regulations were on the agenda for the May ARRS meeting.  They will become effective July 3, 2009.

401 KAR Chapter 5 Regulation Update

DOW filed six administrative regulations with LRC on April 14, 2009.  The public comment period closed on June 1, 2009.  The following administrative regulations are included in the package:

DOW will respond to comments and file amended administrative regulations with LRC by July 15, 2009.  They are tentatively scheduled to appear on the August ARRS agenda.

Drinking Water Package Three

DOW filed five administrative regulations with LRC on May 11, 2009.  The public comment period closed on June 30, 2009.  The following administrative regulations are included in the package:

DOW received comments on all regulations in this package, except 401 KAR 8:510.  A Statement of Consideration will be filed with LRC by July 15, 2009.  The regulations are tentatively scheduled to appear on the August ARRS agenda.

Regulation Promulgation Process


Promulgation is the formal process of putting an administrative regulation into effect. The document below, prepared by DOW, is an informal interpretation of the process for promulgating administrative regulations, as governed by KRS Chapter 13A. It is not a complete legal interpretation of the statute. KRS Chapter 13A is available through the Web site of the LRC. Please see the explanation of the LRC Web site at the top of this page.
