On Feb. 17, 2009, the American Recovery and Reinvestment Act of 2009 became law, which provided the Kentucky Infrastructure Authority (KIA) with economic recovery funds (ERF) for eligible projects.
Communities that have ready-to-go projects on the respective 2010 Priority List and wish to be considered for economic recovery funds MUST submit an ERF Request for Consideration form to the Division of Water by close of business March 9, 2009*. Submit all forms related to the ERF call for projects to amanda.yeary@ky.gov.

UPDATE -- The updated Draft 2010 Drinking Water State Revolving Fund (DWSRF) Intended Use Plan (IUP) and updated Draft 2010 Clean Water State Revolving Fund (CWSRF) IUP -- which now include the CWSRF and DWSRF Economic Recovery Fund (ERF) Priority Lists -- are available for public review and comment here on the Division of Water Web site and on the Kentucky Infrastructure Authority (KIA) Web site.
The public meeting to discuss the DWSRF and CWSRF Draft IUPs will be held at 1:30 p.m. CST May 8 in Frankfort at the KIA conference room located at 1024 Capital Center Drive, Suite 340. The public comment period will remain open until 1:30 p.m. May 11, 2009.

The project selection process for ERF projects will be based on the selection criteria for all SRF project funds plus additional requirements. Funding priority will be given to drinking water or clean water projects that will be able to start construction by June 17, 2009. The Act requires that 20 percent of the funds are made available for green infrastructure, water efficiency and energy efficiency projects through that date. Any remaining funding not committed by June 17, 2009, will give funding priority to drinking water or clean water projects based on readiness to proceed, with consideration given to job creation, economic hardship and environmental benefits. All projects must have a construction start date prior to Feb. 16, 2010. The purpose of the ERF is to expand the economy and create and maintain jobs.
The Division of Water and the Kentucky Infrastructure Authority have announced a call for projects for fiscal year 2010 through the Drinking Water State Revolving Fund (DWSRF) program. View the 2010 Call for Projects letter mailed in October 2008 to public water systems.
Public water systems interested in financing a project through DWSRF must submit a project questionnaire during the call for projects period as a preliminary to being placed on the project priority list. Water systems that are not on the project priority list will not be considered for funding. Applicants with projects on the 2009 project priority list who would like to be considered for funding in the 2010 cycle, must notify the Division of Water DWSRF coordinator (information below) in writing of their interest. Any projects with significant changes will require submission of the 2010 project questionnaire.

Completed 2010 project questionnaire forms are due to the Division of Water no later than Dec. 5, 2008.
Projects submitted by systems lacking technical, managerial or financial capacity or significant noncompliers are not eligible for funding unless the proposed project will improve capacity or compliance. Refer to capacity development.
Based on the information provided from the questionnaire, a document is produced that identifies the intended uses of the DWSRF program funds. Called the Intended Use Plan (IUP), this document is prepared annually by the primacy agency (state) for the Environmental Protection Agency (EPA) and the public. The public has an opportunity to review and comment on the IUP before it is sent to EPA. Refer to the "right-to-know" provisions.
The IUP identifies how the money will be distributed and describes how those uses support the overall goals of the DWSRF program. Chief of these goals is public health protection. Included is a description about how the IUP meets the objectives (public health protection goals) of the Safe Drinking Water Act.
IUPs identify eligible projects and their priorities based on three primary criteria. These criteria determine which projects receive first priority for funding. Priority is given in a ranking order to those projects that:
- address the most serious human health risks
- ensure or maintain compliance with the Safe Drinking Water Act
- assist systems with greatest economic needs
